Terms of Service
Updated 15 September 2026 · version 2026-10-12
These Terms are a contract between you and Flyte Technologies Inc, a Delaware corporation (“Mutuals”, “we”, “us”). They govern your use of the Mutuals website, app and services. By creating an account, ticking the box at sign-up, or using the service, you agree to them. If you do not agree, do not use the service.
Read section 9 (Your content and your risk), section 11 (Disclaimer), section 12 (Limitation of liability) and section 15 (Arbitration and class action waiver). They affect your legal rights.
1. Who can use Mutuals
You must be at least 18 years old and able to enter a binding contract. Membership is by application and at our sole discretion. We may decline, suspend or terminate any account at any time, for any reason or no reason, without notice or liability.
2. Your account
One account per person. You are responsible for everything that happens under your account, including anyone who signs in using your email. Keep your email account secure. Tell us straight away if you think your account has been used without your permission.
3. Accurate information
Everything you tell us and show others must be true. Your audience figures, your platforms, your name and your photos must be yours and accurate. Inflating reach, buying followers, impersonating anyone, or presenting someone else’s work as your own is a breach of these Terms and grounds for immediate removal. We may, but are not obliged to, verify any claim you make.
4. What Mutuals is, and is not
Mutuals introduces creators to each other. That is all it does. We are not a party to any collaboration, agreement, payment, or relationship between members. We do not vet members beyond what is described here, we do not run background checks, and we make no promise about who anyone is, what they will do, or whether a collaboration will happen or succeed.
Where the service lets two members record terms they have agreed, that record is a convenience for them. It is not a contract with us, we do not enforce it, we do not hold or move money under it, and we have no responsibility for whether either member performs.
5. Conduct
You agree not to:
- harass, threaten, abuse, stalk or defame anyone;
- post anything sexual, violent, hateful, illegal, or infringing;
- send spam, bulk pitches, scams, or solicitations for money;
- scrape, crawl, copy, reverse engineer, or access the service by any automated means;
- interfere with the service, its security, or anyone else’s use of it;
- record, screenshot, or share another member’s messages or photos outside the service without their consent;
- use the service for anything other than finding creative collaborators.
We may remove content and terminate accounts that breach this, and we may report unlawful conduct to the authorities.
6. Your content
You keep ownership of the photos, text and other material you upload. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example to resize), display and distribute that material within the service, and to use it to operate, promote and improve the service, for as long as it is on the service and for a reasonable period after removal for backups and legal compliance. You confirm you own or have the rights to everything you upload, and that it does not infringe anyone else’s rights or violate any law.
7. Our content
The service, its design, its software and everything in it that is not member content belongs to us or our licensors and is protected by intellectual property law. You may not copy, modify, sell, or create derivative works from it.
8. Moderation and removal
We may review, moderate, refuse, or remove any content at any time without notice. Automated systems screen uploaded images. We do not guarantee that any content, member, or message is appropriate, accurate, lawful or safe.
9. Your content and your risk
Anything you share on Mutuals, including private messages and photos, you share at your own risk. Other members can see, save, screenshot, copy, and share what you send them, and we cannot prevent that. You are responsible for deciding what to share and with whom. To the fullest extent permitted by law, we are not responsible or liable for any use, disclosure, leak, loss, or misuse of your content or messages by other members, by third parties, or as a result of unauthorised access, security incidents, or data breaches, however caused, including where caused by our negligence.
10. Interactions with other members
You are solely responsible for your interactions with other members, online and in person. We do not screen members. Use your own judgement, meet in public, and tell someone where you are. To the fullest extent permitted by law, we are not liable for the conduct of any member or for anything that happens as a result of a connection made through the service, including any loss, injury, or damage.
11. Disclaimer of warranties
The service is provided “as is” and “as available”, with all faults, and without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or usage. We do not warrant that the service will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, or that it will meet your requirements or produce any particular result, match, collaboration, revenue, or growth.
12. Limitation of liability
To the fullest extent permitted by law, in no event will Mutuals, Flyte Technologies Inc, or our officers, directors, employees, contractors or agents be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity, or reputation, arising out of or relating to the service or these Terms, however caused and under any theory of liability, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the service or these Terms will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars (US$100).
Some jurisdictions do not allow some of these exclusions. In those places, our liability is limited to the smallest amount the law permits.
13. Indemnity
You will defend, indemnify and hold harmless Mutuals, Flyte Technologies Inc and our officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or relating to your content, your use of the service, your interactions with other members, or your breach of these Terms or any law.
14. Membership and sparks
Some features may be paid. Prices are shown before you buy. Payments are processed by our payment providers and are subject to their terms. Except where the law requires otherwise, purchases are final and non-refundable, and unused virtual items have no cash value, cannot be transferred, and expire when your account closes. Everything is currently free while the service is in beta.
15. Arbitration and class action waiver
Please read this carefully. It affects how disputes are resolved.
Any dispute, claim or controversy arising out of or relating to these Terms or the service, including its existence, validity, or termination, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Cook County, Illinois, or remotely by video, at the claimant’s election. The Federal Arbitration Act governs this clause. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small claims court if it qualifies.
You and we each waive the right to a jury trial and the right to bring or participate in any class, collective, or representative action. Claims may only be brought in an individual capacity.
You may opt out of this arbitration clause by emailing ezulqarni3@gmail.com within 30 days of first accepting these Terms, stating your name, handle and that you opt out. Opting out does not affect any other part of these Terms.
16. Governing law
These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict of law principles. Subject to section 15, the state and federal courts located in Delaware have exclusive jurisdiction, and you consent to their jurisdiction.
17. Time limit on claims
To the fullest extent permitted by law, any claim arising out of or relating to the service or these Terms must be brought within one year after it arose, or it is permanently barred.
18. Termination
You can delete your account at any time from Settings. We can suspend or terminate your account at any time, with or without notice, for any reason. On termination your licence to use the service ends, and sections 6, 7, 9 to 13, and 15 to 20 survive.
19. Changes
We may change these Terms. The version date is shown at the top of this page. If a change is material, we will ask you to accept it the next time you use the service. Continuing to use the service after a change means you accept it.
20. General
These Terms, with the Privacy Policy, are the entire agreement between you and us about the service. If any part is found unenforceable, the rest stays in force and the unenforceable part is enforced to the maximum extent permitted. Our failure to enforce any right is not a waiver of it. You may not assign these Terms; we may. Nothing here creates a partnership, agency or employment relationship. Notices to us go to ezulqarni3@gmail.com.
